TERMS OF SERVICE

 

These terms of use (Terms) govern your use of the mobile application 'MEX (App) and the Services. The App and the Services are being provided by Quantified Communities Services Private Limited.

 

By clicking ["I Accept"] OR ["I Agree"], you signify your acceptance of the Terms and agree to be bound by them for as long as you are using or accessing the App or the Services.

 

We may amend the Terms from time to time and you agree to be bound by the revised Terms as and when they are amended. You are encouraged to revisit the Terms regularly.

 

If you do not agree to these Terms, please do not access or use the App or the Services. By continuing to use the App, you are indicating that you have agreed to be bound by the Terms.

 

For the purposes of these Terms, We, Us or Our shall mean Quantified Community Services Private Limited. The terms You, Your, or User shall mean any person or entity accessing, browsing through and/or using the App and/or the Services. The term Campus shall refer to your workplace. 

 

 

GENERAL TERMS

 

 

ELIGIBILITY

 

You can access or use the App or the Services only if you are eligible to form legally binding contracts under Indian Contract Act, 1872  and you represent that you are not subject to any law/judicial order or contract inconsistent with the Terms. We reserve the right to refuse to provide you with access to the Services if it is brought to our notice that you cannot form legally binding contracts.

 

 

DATA PROTECTION

 

We may collect certain personal information about you for the purpose of providing you the Services. For information about how we use the information collected from you, you may refer to our Privacy Policy available at https://www.mexit.in/privacy-policy. If you choose not to provide this information you may not be able to avail the benefits of the full range of our services. 

 

 

LICENSE

 

The App may contain copyrighted material, trademarks, and other proprietary information and intellectual property owned by us or other third parties. Mere access to or use of the App do not confer upon you any rights to the intellectual property belonging to us or any third party. You agree not to copy, modify, publish, transmit, distribute, perform, display, or sell any such intellectual property except for that information which is in the public domain or for which you have been given permission. Any use of the App or its contents without our permission is prohibited.

 

The following trade names/ trademarks indicated on the App are our trade names/ trademarks and may not be used in connection with any product or service that is not ours in any manner that is likely to cause confusion among Users or that disparages or discredits us, the App or the Services:

TERMS OF ACCESS

By accessing the App and or the Services, you agree that you will use the App and avail the Services for lawful purposes only and comply with all applicable laws and regulations. You agree that you will not do anything that may impair the performance or any functionality of the App or the servers on which the App is hosted.

 

You agree to provide authentic and true information in all instances where any information is requested of you. If at any time, the information provided by you is found to be false or inaccurate (wholly or partly), we reserve the right to suspend or terminate your access to the App and the Services in the future without any prior intimation whatsoever.

 

When you access the App and or the Services, you agree not to (i) scrape or attempt to scrape or extract any data, including information provided by third parties or other Users of the App, (ii) use the App for any monitoring, benchmarking or throttling or any other purposes that may impair the performance or functionality of the App, (iii) access or attempt to access any content available on the App by any means other than through the interface provided by us. 

 

You agree that while using the App or the Services, you will not post, upload, publish, transmit or share any material or information that: (a) belongs to another person and to which you do not have any right to; (b) is grossly harmful, harassing, blasphemous defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; (c) harms minors in any way; (d) infringes any patent, trademark, copyright or other proprietary rights; (e) violates any law for the time being in force; (f) deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature; (g) impersonates another person; (h) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; (i) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation. In the event, we receive any court order or notification from a government agency that any information posted by you amounts to a breach of this provision, we will take such steps necessary as required under law to remove or disable access to such information and may suspend or terminate your access at our sole discretion.

 

DISRUPTION

 

It is our endeavor to ensure that the App and Services are accessible to you from everywhere on a 24x7 basis. However, we may, from time to time and without prior notice of downtime, suspend access to the App or to some parts thereof for maintenance or other reasons. We may also, at our sole discretion, either temporarily or permanently disable access to the App for specific Users. You agree that you have no expectation of or right to permanent and uninterrupted access to the App or the Services.

 

 

THIRD PARTY DISCLAIMERS

 

We do not guarantee that other Users of the App will comply with these Terms. You hereby assume all risk of any harm or injury which may result to you on account of such non-compliance by third party Users. We shall not be liable for any such harm or injury resulting from third party use.

 

We do not guarantee or make any representations regarding the content of any third-party sites. We do not offer any implied or explicit warranty with respect to third-party services, and a link to third-party content is not to be deemed as an endorsement of third-party content. If you access a link of any third-party website, you hereby acknowledge that you do so entirely at your own risk and expense.

 

We shall not be responsible for any dispute between you and any other third party arising out of the use of the App or the Services. We shall not be held liable for any negligent conduct or behavior of any third party in relation to the use of the App or the Services.

 

INDEMNITY

 

You agree to indemnify us, our officers, directors and other employees of Quant Commune for all claims, proceedings, penalties, damages, losses, actions, costs and expenses arising out of or in relation to your (i) misuse of the App and/or the Services (ii) breach of these Terms, (iii) violation of any law, rules or regulations or the rights of a third party, or (iv) any fraudulent act on your part.

 

DISCLAIMER OF WARRANTY; LIMITATION OF LIABILITY 

  • The User expressly agrees that use of the mobile application is at the User’s sole risk. Neither Quantified Communities Pvt. Ltd., its holding or subsidiaries, Business Associates nor any of their respective employees, agents, and third party content providers warrant that use of the App will be uninterrupted or error-free; nor do they make any warranty as to (i) the results that may be obtained from the use of this Website or mobile application, or (ii) the accuracy, reliability or content of any information, service or merchandise provided through the Website or mobile application.

 

  • The App is made accessible on an “as is” basis without warranties of any kind, either expressed or implied, including, but not limited to, warranties of title or implied warranty of merchantability or fitness for a particular purpose, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement.

 

  • We do not give any warranty that the App is free from viruses or anything else which may have a harmful effect on any technology.

 

  • We reserve the right to change, modify substitute, suspend or remove without notice any information or Voucher or service from the Website or mobile application forming part of the Service from time to time.  Quantcommune has no control over any promotions being run by the third-party service providers.

 

  • Your access to the App and/or the Services may also be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services.  We will attempt to restore such access as soon as we reasonably can. We assume no responsibility for functionality which is dependent on your browser or other third party software to operate.  For the avoidance of doubt, we may also withdraw any information from the App at any time.

 

  • We reserve the right to block access to and/or to edit or remove any material which in our reasonable opinion may give rise to a breach of this Agreement.

 

  • This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action. The User specifically acknowledges that we are not liable for the defamatory, offensive or illegal conduct of other users or third-parties and that the risk of injury from the foregoing rests entirely with the User.

 

  • In no event shall Quantified Community Services Pvt. Ltd., or any Business Associates, producing or distributing the Website or the content hereof, mobile application and any software, be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages arising out of the use of or inability to use the Website or mobile application. The User hereby acknowledges that the provisions of this Clause shall apply to all content on the Website and mobile application.

 

  • In addition to the terms set forth above, neither Quantified Community Services Pvt. Ltd., nor its subsidiaries and Business Associates, Third Party Service Providers or Third Party Content Providers shall be liable regardless of the cause or duration, for any errors, inaccuracies, omissions, or other defects in, or untimeliness or unauthenticity of, the information contained within the Website, or for any delay or interruption in the transmission thereof to the user, or for any claims or losses arising therefrom or occasioned thereby. None of the foregoing parties shall be liable for any third-party claims or losses of any nature, including without limitation lost profits, punitive or consequential damages.

 

  • We will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement will not exceed the total Offer price paid or payable to you under this Agreement.

 

 

You hereby acknowledge and agree that we will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, reputation, goodwill, business opportunity, data or other intangible losses or be liable for any loss or damages of any kind whatsoever arising out of the use of or inability to use the App and Services, however arising whether by tort or by contract, including without limitation, damages for loss or corruption of data or programs and service interruptions, even if we know or have been advised of the possibility of such damages.

 

We also disclaim any and all liability for the acts, omissions and conduct of any third parties in connection with or related to the use of the App and Services. We will not be responsible or liable for any damages or losses resulting from any correspondence or business dealings with third-party service providers or advertisers or resulting from the presence of such advertisers on the App.

 

We are maintaining the App and providing the Services on an "as is" basis and offer no warranties of any kind, whether express, implied, statutory or otherwise with respect to the App or the Services. We specifically disclaim any implied warranties of fitness for a particular purpose or non-infringement. You expressly agree that the use of the App and/or the Services is at your own risk and that you will not hold us responsible for any content that may be deemed offensive, indecent, or objectionable to you. In particular, we will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, or for any loss of any kind arising out of the use of or inability to use the App or the Services.

SUSPENSION/TERMINATION

 

If you violate or breach any of these Terms, we may suspend or terminate your account or your access to the App and/or the Services, at our discretion. In such event, we shall not be liable for any refunds or damages.

 

GOVERNING LAW & DISPUTE RESOLUTION

 

These Terms shall be governed by the laws of India and any disputes or proceedings arising hereunder shall be subject to the jurisdiction of the courts in Bangalore, India.

 

 

TERMS OF SERVICE

 

 

Smart Access

 

The Smart Access solution allows the users to use their phone to securely enter any RMZ Property where in the app is operationalized. Users will be assigned a 16-digit ID from your Administration Department. This ID must be entered into the app to enable this feature.

 

For the solution to work, the user must have a smartphone with Android 4.4 or above and iOS10 or above. The user will have to ensure that their phone will be in their possession while using the campus and will not be shared with another user to access the RMZ Buildings, user is expected to keep the access credentials secure, not clone or share the same with a third-party, etc. We may not separately verify the authenticity of the person checking in to the campus using the Smart Access. If the phone is lost, or blocked, or changed, the user will have to request for a new mobile token from their Admin and is responsible for notification to the Admin department within 48 hours about the loss/damage of the phone in order for the admin to deactivate the access appropriately.

 

We will maintain anonymous and secure logs of access to the locations where we manage access control. We may disclose this information in the event we receive any court order or notification from a government agency. We may also disclose this information to your organization upon such request.

 

The tenant organizations (Organizations having their offices in RMZ Properties) will generate required mobile tokens and allocate it to their employees. This information will be updated in the Access backend and the access to employees would be allocated as per the buildings occupied by the respective tenant organization. The tenant Admin must immediately revoke the user access from the Tenant Dashboard provided for the purpose, whenever a user leaves the company to deactivate their Access. 

 

We will not be held responsible for any incident that may arise from using the smart access module, including but not limited to, loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data and waste of management or office time.

Feed

The Feed section displays personalized recommendations for you, basis of the information that you choose to share with us. Our Context engine learns your actions and comes up with the best recommendation for you to increase your convenience.

 

These are just recommendations and user can choose to use it or not. These are system generated recommendations and we cannot guarantee the accuracy of these recommendations. We will not be held responsible for any incident that may arise from feed recommendations, including but not limited to, loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data and waste of management or office time.

 

All data collected will be compliant with the data protection laws that are subject to our campuses. For more information please read our privacy policy.

 

 

Campus Assist

 

The Campus Assist allows users to report issues/feedback that has been noticed by the user. The user has the ability to raise a ticket with our teams. RMZ property team will review the tickets and act upon it as per the RMZ Property Team’s discretion. 

 

The user may be allowed to post pictures of the issue to help our ground teams to fix it. The user will ensure that the images do not

  1. Contain tenant’s confidential information

  2. Compromise the safety and security of individual(s) or company

  3. Contain obscene content

 

We will not be held responsible for any incident that may arise from using the Campus Assist, including but not limited to, loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data and waste of management or office time.

 

Polling & Quizzes

 

We will use Polling and Quizzes to collect information that will enhance the experience of the campus. Polling & Quizzes could include multiple choice questions and (or) text inputs from the user.

 

We reserve the right to disqualify votes and (or) the entire poll or quiz if needed. The existence of the poll/quiz does not constitute any representation of future actions to be undertaken by Quantcommune or other third-party. We cannot accept any responsibility whatsoever for any technical failure or malfunction or any other problem with the internet connectivity or line, system, server, provider or otherwise which may result in any vote being lost or not properly registered or recorded.

 

We will not be held responsible for any incident that may arise from conducting the poll, including but not limited to, loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data and waste of management or office time

Invite Visitors

The Invite Visitor Service allows eligible Users to invite visitors into the campus. Users will be required to provide their corporate email addresses to access the Service. We will not be obligated to provide the said service if the email address provided by the User is not registered with us or Smart Access is not enabled.

 

The User will be required to provide us with the accurate email address and phone number of the visitor and to authenticate the visitor. By authenticating the visitor, the User will confirm that the person to whom the entry pass is being provided is the visitor intended by the User and that the identity of such person is known to the User. If the User is not certain about the identity of the visitor, the User must not authenticate such person. The Invite Visitor service is only intended to be used for inviting persons who are known to the Users and must not be used to invite strangers or service personnel into the Campus.

 

We will create an entry pass in the form of a [QR Code] for visitors whose identities have been authenticated by registered Corporate Users and send the QR Code to visitors via email/SMS. We will not independently verify the visitor's identity and will not be liable for any actions of the visitor inside the Campus. The User must ensure that the visitor does not copy, modify, publish, transmit, distribute, or sell the QR code to any third parties or misuse them in any other manner. The User will be solely responsible in the event that any act or omission on the part of the visitor causes harm or injury to us or any third parties. Quant Commune will not be liable for any mishandling of or damage caused to the visitor’s handset by the visitor or any third party.

 

The visitor can use the entry pass to enter the Campus with seamless security verification. The visitor must not delete the QR code till he/she exits the Campus. The Campus security personnel will be entitled to request the visitor to show his/her entry pass any time while the visitor remains in the Campus premises, and the visitor will be required to comply with such requests. The entry pass will only be valid for the visitor specifically authenticated by the User to enter the Campus and cannot be used to bring any other unauthorized guest(s) or for more than one guest on a single-entry pass.

 

The buildings within the Campus may have their own specific security procedures and entry restrictions which the visitor will have to comply with notwithstanding the fact that he or she has been provided with the entry pass. If the building security requires any additional information from the visitor, the visitor will be obliged to provide such information to enter the building. Notwithstanding anything contained in these Terms, the Campus security personnel are entitled, at their own discretion, to require visitors bearing entry passes to undergo security verification or to bar their entry to the Campus if they suspect that the visitor is carrying any dangerous weapons or otherwise poses a threat to any person or property. Visitors bearing entry passes may also have to go through regular security verification if the QR code or the SMS link does not work due to technical errors. We will not be liable to the User or the visitors in any of these cases. We are only a technology provider and are not be responsible for the actual security procedures in the Campus.

 

The User is required to ensure that the visitor enters the Campus at the time specified in the entry pass. The entry pass will be valid only for the duration of the meeting as specified by the User while inviting the visitor. In the event that the visitor arrives with an expired entry pass, he/she will be required to undergo security verification to enter the Campus. The visitor will be given access to only certain parts of the Campus based on the User invitation. If the visitor attempts to access the Campus from an entrance through which the visitor is not authorized to enter, he/she will be required to undergo security verification or re-enter the Campus through the entrance for which the entry pass was intended.

 

We will maintain logs of the visits made to the campus utilizing the Invite Visitor Service for at least 5 years, which shall include the information provided by the User and the visitor, for a period of one year. We may disclose this information, at our sole discretion, to the tenants of the buildings within the campus or to any law enforcement agencies.

 

Offers

 

By accessing the Offers Service, Users will be able to view offers, discounts and other deals from third-party merchants across various categories such as leisure, adventure, luxury, food, household, and fitness.

 

A User interested in redeeming an offer may do so using the voucher which we display along with the Deal information at the store of the relevant merchant. The offers may be valid only for a specific duration and if the User attempts to redeem the offer after its validity period, the relevant merchant may not honor the Deal.

 

The offers are being offered by the respective merchants whose products and/or services featured in such offers. We do not guarantee the redemption or validity of any offers. We merely display the offer information submitted to us by the merchants. We do not verify the terms and conditions of any offer nor do we guarantee that these terms and conditions will be better than the terms offered by the relevant merchants at their store to their customers who are not Users.

 

We do not sponsor any of the offers in any manner. We are not responsible for the products and/or services featured on the offers and we do not provide any warranty or assurance to the Users as to the quality, fitness, merchantability safety, usability, or any other aspect of such products and/or services, as applicable. If the User has any complaints relating to the terms and conditions of the Deals or any of the products/services, the User must directly address such complaints to the relevant merchant.

 

Traffic Updates

 

The Traffic Update Service offers regular traffic updates on key locations in the Campus.  The traffic updates are not intended to replace the information provided on the road in respect of travel direction, lane restrictions, blockades, etc. The Traffic Update Service shares images received from CCTV cameras located in the campus, with the User to allow him or her to assess the traffic situation at key locations throughout the campus. The User is not authorized to take screenshots, copy, modify, publish, transmit, distribute, perform, display, or sell these images or any part thereof. The User will be required to indemnify us for any claim or liability resulting from a contravention of the above condition by the User.

 

The images are updated every 60 seconds and we cannot and do not verify the content of each image. The actual traffic condition may differ on account of change in weather conditions, construction projects, road closures, diversions, cabling work or other such events. The images will be valid only for 60 seconds and the User will be required to refresh the image for a more accurate traffic view. This may be disrupted for reasons beyond our control.

 

Our ability to provide the Traffic Update Service is dependent on the CCTV cameras maintained by the buildings in the Campus. The quality of the Traffic Update Service may be affected by external factors beyond our control such as malfunctioning cameras, deliberate tampering with the image feed, or change in weather. Therefore, we can only provide the Traffic Update Service on an 'as is' basis and do not provide any assurance as to the quality of the Traffic Update Service.

 

The Traffic Update Service also allows Users to generate and post traffic updates and to view the traffic updates posted by other Users. Users are required to be accurate and truthful while posting traffic updates and any User found to be deliberately misleading or untrue in the updates that he or she posts may, at our sole discretion, be prevented from using the Traffic Update Service.

 

Wellness

Our Wellness Service allows Users to book an appointment with the doctor in the campus clinic by calling on the number provided in the screen.  Details mentioned here are based on the information provided by campus clinics owners. We rely on them to provide us with updated information. We do not have any control over the availability of slots. We are not responsible for any alteration in the date, time and duration of the booking. The clinic may become unavailable post booking in certain circumstances such as renovation or shut down of facilities and we will not be responsible for the User's bookings in such circumstances.

 

The clinic is entitled to reserve admission subject to such conditions and we will not be responsible for the booking in such cases. We merely display the offer information submitted to us by the clinic. We do not verify the terms and conditions of an appointment.

 

 

Community

 

The Community Service is available only to Users whose corporate email addresses are registered with us and/or Smart Access is enabled on their phone. The Service allows you to join different groups with other Users based on common interest. Inside the Community, you will be allowed to post articles, images and see posts by other users.

 

While using the Community Service, Users shall not post, upload, publish, transmit or share any material or information that: (a) belongs to another person and to which they do not have any right to; (b) is grossly harmful, harassing, blasphemous defamatory, obscene, pornographic, paedophilic, libelous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; (c) harms minors in any way; (d) infringes any patent, trademark, copyright or other proprietary rights; (e) violates any law for the time being in force; (f) deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature; (g) impersonates another person; (h) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; (i) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation; or (j) is inaccurate, misleading, or irrelevant. The User shall not post any content that violates their corporate/HR policies.

 

In the event, we receive any court order or notification from a government agency that any information posted by a User amounts to a breach of this provision, we will take such steps necessary as required under law to remove or disable access to such information and may suspend or terminate such User's access to the App or the Community Service at our sole discretion.

 

The Service will also allow Users to report any posts by other users and our admin team will review the claim. You may be barred from using the Community service for a short period or indefinitely without prior notice in case of violation of any terms mentioned here or beyond these terms as well.

 

The User acknowledges that all discussion in Community are public and not private communications, and that, therefore, others may read the User’s communications without the User’s knowledge. We do not control or endorse the content, messages or information found in any Communities, and, therefore, we specifically disclaim any liability concerning the Community and any actions resulting from the User’s participation in any groups, including any objectionable content. Generally, any communication which the User posts on the Community is considered to be non-confidential. If a particular app section permits the submission of communications that will be treated by us as confidential, that fact will be stated on those pages. By posting comments, messages or other information on the application, User grants Quantified Community Services Pvt. Ltd. the right to use such comments, messages or information for promotions, advertising, market research or any other lawful purpose. For more information see Quantified Community Services Pvt. Ltd. Payments

 

We have partnered with payment gateways to facilitate payments and refunds in relation to the Services. The payment gateways will be responsible for processing the payments to various services and refunds to the Users. The payment options available on the Service depending on the arrangements between the payment gateway providers and payment instrument providers.

 

The payment gateway may collect your debit card/debit card/other payment instrument details based on the payment option you select in order to facilitate processing your payments/refunds as applicable. We do not collect, store or otherwise handle this information and we will not be responsible for this information in any manner, including but not limited to any loss resulting from fraudulent transactions or misuse/mishandling of this information by the payment gateways.

 

Track Shuttle

 

The module allows Users to track Campus shuttles in real time. We do not guarantee the accuracy of Service feed which may depend on the change in weather conditions, construction projects, road closures, diversions, cabling work or other such events and may be disrupted for reasons beyond our control.


Events & Activities

 

This module displays the latest events that will take place in RMZ campuses. Registration to the event may be required. We will only make the event available for viewings and(or) registration on the app. You will have to abide by the Terms and Conditions mentioned by the events. Nature of the events could be offline as well as online. You may be asked to share further details depending on the nature of the event. During the event you might be asked to furnish your company ID for security and verification purposes. You may be denied participation and/or entry to the venue of events should the Event Management decides at its sole discretion.  

Marketplace Services – Swiggy, Ola, Uber, Bookmyshow, Cleartrip Hotels, Cleartrip Flights, GoCharge 

  • By accessing the Marketplace Service, Users will be able to transact with third-party merchants across various categories on the App itself. We may add or remove merchants at our sole discretion. A User interested in using Marketplace Services may do so by clicking on the select brand icon. There might be exclusive offers from these brands which may be valid only for a specific duration and if the User attempts to redeem the offer after its validity period, the relevant merchant may not honor the Deal.

  • We do not guarantee and control the fulfillment of these services. We merely enable the transaction on our App for these merchants, basis the information submitted to us by the merchants. We do not verify the terms and conditions of any service nor do we guarantee that these terms and conditions will be better than the terms offered by the relevant merchants at their store to their customers who are not Users.

  • We are not responsible for the products and/or services offered by these merchants and we do not provide any warranty or assurance to the Users as to the quality, fitness, merchantability safety, usability, or any other aspect of such products and/or services, as applicable. If the User has any complaints relating to the terms and conditions of a particular merchant or any of the products/services, the User must directly address such complaints to the relevant merchant.

  • We are not responsible for services provided by the merchant made available through the Marketplace Services and shall not be liable in any way for the failure of the merchant to meet the User's specific requirements. Any complaints relating to the service must be directly taken up with the concerned merchant.

  • Quantified Community Services Pvt. Ltd., similar to an Internet Service Provider, is an intermediary (and not a publisher) of content supplied by these merchants. Accordingly, We do not have editorial control over such content. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by merchants, including Third Party Content Providers, are those of the respective merchants and not of Quantified Community Services Pvt. Ltd.

  • Neither we nor any third-party provider of information guarantees the accuracy, completeness, or usefulness of any content, nor its merchantability or fitness for any particular purpose (refer to Clause for ‘Disclaimer of Warranty, Limitation of Liability’).

 

  • In many instances, the content available through this App represents the opinions and judgments of the respective information provider, User, or other user not under contract with us. We neither endorse nor are responsible for the accuracy or reliability of any opinion, advice or statement made on the App by anyone other than our authorized employee/spokespersons while acting in official capacities.

 

  • Under no circumstances will we be liable for any loss or damage caused by a User’s reliance on information obtained through the App. It is the responsibility of the User to evaluate the accuracy, completeness or usefulness of any information, opinion, advice, etc. or other content available through the App. 

  • The App may contain links to third-party websites maintained by other content providers. These links are provided solely as a convenience to you and not as an endorsement by us. Of the contents on such third-party websites and App hereby expressly disclaim any representations regarding the content or accuracy of materials on such third-party websites. If the User decides to access linked third-party websites, the User does so at his/her own risk.

 

Ignite Book Pod

 

The Ignite Book Pod Service allows eligible Users to borrow and donate books from the specially designed booths placed in certain campuses. Users will be able to access this service if they are verified via Corporate email verification of Smart Access is enabled. We will not be obligated to provide the said service if proper verification is not done. User agrees that he/she will use the service ethically and return the picked-up books within the specified time. We reserve the right to deny any book request or ask you to return the book before the deadline.

 

 

ADVERTISEMENT

 

  • Quantified Community Services Pvt. Ltd. may place advertisements in different locations on the App and at different points during the use of the Service. These locations and points may change from time to time - but we will always clearly mark which services are advertisements (i.e. from persons other than us), so that it is clear to you which services are provided on an objective basis and which are not (i.e. the advertisements)

 

  • You are free to select or click on advertised services or not as you see fit.

 

  • Any advertisements may be delivered on our behalf by a Third Party Advertiser.
     

  • No personal data (for example your name, address, email address or telephone number) will be used during the course of serving our advertising, but, on our behalf, our Third Party Advertiser or affiliate may place or recognize a unique "cookie" on your browser (see our Privacy Policy about this). This cookie will not collect personal data about you nor is it linked to any personal data about you. FORCE MAJEURE

 

Without prejudice to any other provision herein, we shall not be liable for any loss, damage or penalty as a result of any delay in or failure to deliver or otherwise perform hereunder due to any cause beyond our control, including, without limitation, acts of the User, embargo or other governmental act, regulation or request affecting the conduct of our business, fire, explosion, accident, theft, vandalism, riot, acts of war, strikes or other labour difficulties, lightning, flood, windstorm or other acts of God.

 

MONITORING

 

Quantified Community Services Pvt. Ltd. shall have the right, but not the obligation, to monitor the content of the App at all times, including but not limited to Community Posts and groups that may hereinafter be included as part of the App, to determine compliance with this Agreement and any operating rules established by Quantified Community Services Pvt. Ltd., as well as to satisfy any applicable law, regulation or authorized government request. Without limiting the foregoing, Quantified Community Services Pvt. Ltd. shall have the right to remove any material that Quantified Community Services Pvt. Ltd. in its sole discretion, finds to be in violation of the provisions hereof or otherwise objectionable.


 

TERMINATION

  • We may terminate this Agreement at any time. Without limiting the foregoing, We shall have the right to immediately terminate any passwords or accounts of User in the event of any conduct by the User which Quantified Community Services Pvt. Ltd. in its sole discretion, considers being unacceptable, or in the event of any breach by User of this Agreement.

 

  • One User can have only one Account with a unique e-mail ID and a unique phone number. If Quantified Community Services Pvt. Ltd. has any suspicion or knowledge that any of its Users have created multiple Accounts  with different email addresses or phone numbers (including but not limited to account creation by using false names or providing misleading data for creating those Accounts or using disposable email addresses or disposable phone numbers) to generate additional cash back credits or misuse or take undue advantage of the promotional benefits being provided on the App , then we may while reserving its rights to initiate civil and/or criminal proceedings against such User may also at its sole discretion terminate, suspend, block, restrict, cancel the Account of such User and/or disqualify that User and any related Users from availing the services ordered or undue benefits availed through these accounts.  

 

  • All such provisions wherein the context so requires, including Clauses on Intellectual Property Rights, Disclaimer of Warranty, Limitation of Liability, License Grant, Indemnification and Termination above will survive termination of this Agreement.

 

  • Our right to terminate this Agreement shall not prejudice any other right or remedy we may have in respect of any breach or any rights, obligations or liabilities accrued prior to termination.

 

  • The User warrants that they will not use the mex. app for any purpose that is unlawful or illegal under Indian law. In addition, the App shall not be used in any manner, which could damage, disable, overburden or impair it or any events promoted in the app.

 

  • The User agrees to indemnify, defend and hold harmless Quantified Community Services Pvt. Ltd. from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by us by virtue of any breach or non-performance of events.
